Jaitley tap: court refuses to hear constable’s bail plea

A magisterial court in New Delhi today rejected a hearing on the bail plea of a policeman accused in the case of phone-tapping of Bharatiya Janata Party leader Arun Jaitley on the grounds that it is outside the court's jurisdiction.
Chief metropolitan magistrate Vidya Prakash refused to entertain the plea submitted by constable Arvind Dabas. The magistrate cited a Delhi High Court order dividing the national capital region (Delhi NCR) into 11 metropolitan areas as of 1 March (Friday).
The court decided not to hear the matter after a special cell of the Delhi police argued that the proceedings should be kept in abeyance till the issue of jurisdiction is clarified.
The jurisdictional issue has cropped up because the Delhi High Court has divided the national capital into 11 metropolitan zones from March 1 this year, where each zone will have a separate chief magistrate.
Arvind Dabas was the first to be arrested for illegally accessing call records of politicians, businessmen, and other VIPs. He is in judicial custody.
Three others, supposed to be private detectives, have also been arrested.
Police claim that a Delhi-based businessman is behind the conspiracy, and that private detectives as well as constable Dabas were hired to spy on at least 15 important persons.
