Janata Party chief Subramanian SwamyThe special CBI court set up for cases related to the 2G spectrum allocation scandal today started recording the statement of Janata Party chief Subramanian Swamy, who is seeking to indict home minister P Chidambaram in the matter.

Swamy told the court in New Delhi that Chidambaram should be made an accused in the case, as he had sanctioned the decision on spectrum prices taken by former telecom minister A Raja, who has been behind bars in judicial custody for around eight months now.

Testifying as a witness in support of his private complaint seeking the prosecution of Chidambaram, Swamy said Raja could not be held guilty "alone" of the charges that he fixed the price of spectrum licence in 2008 at the prevailing rates of 2001.

Chidambaram was the finance minister in 2007-2008, when the suspected scam occurred.

"Raja could not be guilty of this alone (fixing spectrum prices at 2001 levels and allotment without competitive bidding). He committed this offence with the active connivance of Chidambaram," Swamy told judge O P Saini.

He said that as per a cabinet decision, Raja and Chidambaram were empowered to determine the spectrum price jointly.
