2G: Raja's secretary Chandolia may land back in jail under SC ruling

R K Chandolia, the private secretary to former telecom minister A Raja, may find himself back in jail after the Supreme Court today stayed the Delhi High Court's proceedings under which he was granted bail in the 2G spectrum case.

The matter is listed for further hearing in the apex court on Thursday.

Chandolia emerged out of Tihar Jail on 1 December after being granted bail by the special CBI court trying the case. Subsequently the high court stayed the trial court order granting bail to Chandolia.

A day after Chandolia got out of Tihar after getting bail, the high court took suo motu cognizance of news reports and said that the stay would be operative if he was not released from the prison.

Today a Supreme Court bench headed by Justice Altamas Kabir said that the interim order of the Delhi High Court passed on 2 December 2011 shall remain stayed till a bench headed by Justice G S Singhvi which had granted bail to five corporate executives in the case decides Chandolia's plea.

"Since the application (of Chandolia) concerns the certain set of circumstances arising out of 2G spectrum scam which had been taken up by a bench headed by Justice G S Singhvi, we are of the view that the special leave petition (filed by Chandolia) to be taken by the same bench," the bench, also comprising justices S S Nijjar and J Chelameswar, ruled.

Chandolia was granted bail by the special CBI court hearing the 2G case. But the high court stayed the bail and had directed Chandolia to appear before it on Wednesday.
