Bombay High Court dismisses pilots petition regarding duty hour rules

Mumbai: The Bombay High Court has dismissed a petition filed by a pilots association against the Directorate General of Civil Aviation's (DGCA) decision to implement the 1992 rules instead of the newly framed ones regarding duty hour limitations.

A division bench of Justices RMS Khandeparkar and Amjad Sayed had heard an application filed by pilots of Jet Airways, Air India and Indian Airlines, which opposed a decision by the DGCA to keep its newly framed 2007 rules regarding duty hours of pilots in abeyance.    

The new rules, under the Civil Aviation Requirements (CAR), limit the pilot's duty hours and were meant to replace old rules framed fifteen years ago, in 1992.    

Soon after announcing the new rules, the DGCA received representation from airlines because of which it backtracked and put the new rules on hold.  It formed a new committee to amend the old rules and said that for the time being the 1992 rules would prevail.    

According to the pilots associations, the 2007 rules were put into cold storage because they lessened duty hours of the pilots and compelled airlines to hire more pilots.    

DGCA said it had a right to amend rules or keep them in abeyance and that the 1992 rules, which had been in operation for 15 years, could not be said to be causing much hardship to pilots now.
