Court dismisses Broadcom complaint against Qualcomm

Qualcomm Incorporated, a leading developer and innovator of advanced wireless technologies, products and services, said that the US District Court for the Southern District of California has dismissed a case filed by its rival, Broadcom on royalties gained on exhausted patents.

Hearing the case, bought on by Broadcom in February 2008, Judge William Hayes dismissed the case as the petitioner failed to identify any specific patents which were allegedly exhausted.

Broadcom, a supplier of semiconductors had alleged that Qualcomm was misusing exhausted patents, which resulted in double recovery of royalties thereby bringing a windfall profits for Qualcomm.

Broadcom also failed to show it was entitled to declaratory relief because it did not identify any specific patents which were allegedly exhausted, or an exhaustion triggering sale or license.

The court also ruled that Broadcom's purported injuries were too speculative to support the claims alleged.

San Diego, California-based Qualcomm is caught up with many court cases filed by Broadcom including one filed with the International Trade Commission.
