CWG Scam: HC denies Swiss firm’s plea to stay summons

Suresh KalmadiThe Delhi High Court today dismissed a plea by Swiss Timing to stay a lower court proceeding against them in the Commonwealth Games Time Scoring and Results TSR scam, one among several related to the 2010 games in New Delhi.

The Swiss firm had sought restriction on possible coercive action against it for not appearing in a trial court in connection with the case. It said the Central Bureau of Investigation had not followed correct procedure to execute the summons on an offshore company, and therefore the proceedings could not be allowed.

A division bench of Justice Mukta Gupta tersely said, "The petition is dismissed."

Swiss Timing is accused of getting a contract illegally and causing a loss of over Rs90 crore to the exchequer.

The firm alleged that the CBI did not send the translated version of documents, along with the summons, to Swiss Timing, and it was in violation of international law.

Advocate Amit Desai, appearing for the Swiss firm, said improper service of summons outside India impinged on the sovereignty of Switzerland.
