Indonesian firm files trademark suits against Mumbai cosmetic firms

One of the largest Indonesian soaps and detergent manufacturing companies, PT Wings Surya, has slapped a case against Mumbai-based Olivia Impex , G&Y Soaps and Silvassa-based J K Cosmetics, seeking damages for illegally manufacturing and exporting beauty soaps under its brand GIV.

The two Indian companies were also using identical packaging bearing the plaintiff company''s name and address for exporting counterfeit GIV soaps.

The Bombay High Court granted an ex parte injunctive relief to PT Wings Surya and restrained Olivia Impex, G&Y Soaps and J K Cosmetics and other parties from using the brand name and packaging.

The court in its order has restrained partners, principal officers, servants, agents and representatives of the Indian companies from "manufacturing, marketing and exporting goods i.e. beauty soap under the trademark GIV and also from reproducing, printing, publishing or packaging material.

Sungkono Sadikin, head of international business, PT Wings Surya, said: "The beauty soap GIV, which is a registered and popular brand of PT Wings Surya around the world, was being illegally manufactured in India and exported to African and Gulf countries by the accused.

"In a raid conducted at the manufacturing units of G&Y Soaps and J K Cosmetics, a large quantity of duplicate soaps along with tons of fake printed material worth Rs. 3.5 million in the international market was seized."
